    Here I have a depositary for various SB 10 challenges that are being made. If you have anything please forward it to me. I can remove personal references if you like if the filed is sent in a format that can be modified. Please keep in mind that many of this motions are public record and have or will be filed.

    When filing motions there are a few things need to know. If in doubt it is never a bad idea to call the Clerk and ask what they require and prefer. Some counties do thing differently than others.

  1. All items that need to be notarized need to be signed in the presence of the notary before you make your copies. 

  2. Sign your Original in blue ink, not required but its a good thing to do.

  3. Each motion is a separate filing, 

  4. Make at lease five copies, six if you can.

  5. After making the copies make the original as original in the cover page of each motion.

  6. Mail of hand deliver the original and 3 copies to the clerk of courts.

  7. Staple each copy of each motions in the upper left hand corner. Remember that you are filing 2 or 3 motions.

  8. Check to see what the filing fee may be. Each county if different and if indigent there may be  reduced or no fees.

  9. If mailing make one copy "Time stamp and return". Be sure to include and self addressed stamped envelope with adequate postage.

  10. If delivering by had, which I suggest if you can, Give the clerk the original and two copies. Then ask to have your remaining copied time stamped.

  11. Mail of hand deliver a copy to the prosecutor

  12. Then wait of  a response. In many counties you can watch you case thought to Clerk of Courts website.

    All motions are now finished. In these motions I have highlighted in red the personal details       you need to add or change. Read each motion entirely and do not count on the personal         details to be in red.

 

 

       Reclassification motion from Tier 3 to Tier 1 or 2

  • Reclass petition (DOC)

    After the above motion is completed I will work on one for people going from a SO to Tier 3.
